StageSend Terms of Use

These Terms of Use govern your use of the StageSend mobile application, provided by Sleepycat Software LLC("Sleepycat Software," "we," "us," or "our").

By downloading or using StageSend, you agree to these Terms.

1. Using StageSend

StageSend gives you a limited, personal, non-exclusive, non-transferable license to use the application on devices you own or control, subject to these Terms and the rules of the app store through which you obtained it.

You may not copy, resell, redistribute, reverse engineer, interfere with, or misuse StageSend except where applicable law expressly permits it.

2. Free access and Lifetime Pro

StageSend Free includes unlimited saved events, unlimited editing, stage plots, input lists, monitor requests, and live previews. You may generate one PDF at no charge. The first PDF is saved locally as a frozen PDF and HTML snapshot and can be reopened, saved, shared, and printed indefinitely without generating another document.

Lifetime Pro is an optional one-time purchase that unlocks unlimited new and updated PDF generation, saving, sharing, and printing. It is not a subscription.

Generating a new or updated PDF after the free PDF requires Lifetime Pro. Deleting the source event does not reset the free-PDF allowance or remove the saved PDF.

3. Purchases and Refunds

Purchases are processed by Apple App Store or Google Play, not directly by Sleepycat Software.

Purchase restoration requires the same applicable store account used for the original purchase. Apple purchases do not transfer to Google accounts, and Google purchases do not transfer to Apple accounts.

Refund requests and payment disputes are handled according to the policies of the store that processed the purchase.

4. Your Data

StageSend stores event information locally on your device. You are responsible for safeguarding your device and maintaining any backups available through your operating system.

Deleting StageSend, deleting an event, losing the device, or experiencing device or storage failure may result in permanent loss of event data. StageSend does not currently provide cloud synchronization or independent cloud backups.

Whole-app backups contain editable StageSend data only. They do not include the saved free PDF, its allowance marker, RevenueCat identity, or purchase status.

5. Your Content

You retain ownership of the event information, stage plots, input lists, notes, PDFs, and other content you create using StageSend.

You are responsible for ensuring that your content and your use of StageSend comply with applicable laws and do not infringe the rights of others.

6. Ownership

StageSend, including its software, design, branding, and other materials, is owned by Sleepycat Software or its licensors. These Terms do not transfer ownership of StageSend or grant rights beyond the limited right to use it.

7. Availability and Changes

We may update, modify, suspend, or discontinue parts of StageSend. We do not guarantee that every feature will always be available on every device or operating-system version.

We may also update these Terms. The effective date above will be revised when updated Terms are published.

8. Disclaimer

StageSend is provided "as is" and "as available." To the maximum extent permitted by law, Sleepycat Software disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

StageSend is a planning and document-generation tool. You remain responsible for reviewing stage plots, input lists, monitor requests, technical requirements, and exported documents before relying on or distributing them.

9. Limitation of Liability

To the maximum extent permitted by law, Sleepycat Software will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost data, lost profits, missed performances, equipment issues, or production problems arising from your use of StageSend.

Our total liability relating to StageSend will not exceed the greater of the amount you paid for StageSend or ten U.S. dollars.

Some jurisdictions do not allow certain warranty exclusions or liability limitations, so portions of these sections may not apply to you.

10. App Store Terms

Your use of StageSend is also subject to the applicable terms of Apple App Store or Google Play. If these Terms conflict with mandatory app-store terms, the applicable app-store terms control.

For applications obtained through Apple App Store, Apple is not responsible for providing maintenance or support for StageSend, and Apple is a third-party beneficiary of the applicable license terms.

11. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules, except where the laws of your jurisdiction require otherwise.
